ComfortStop Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Landform Solutions Pty Ltd (ABN 40 113 719 010), trading as ComfortStop ("ComfortStop," "we," "us," or "our"), governing your use of the ComfortStop mobile app, the website at comfortstop.travel, and any related services (together, the "Service").

By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Please also read our Privacy Policy, which explains how we handle your personal information and forms part of this agreement by reference.

1. Eligibility

You must be at least 18 years old to create an account or use the Service. By using the Service, you confirm that you meet this requirement and that you have the legal capacity to enter into this agreement.

2. The Service

ComfortStop helps travelers find clean, accessible café bathroom stops in cities across Europe and beyond, using a combination of community reviews, venue information, and third-party data (including Google Places, OpenStreetMap, and Mapillary).

ComfortStop's coverage grows over time and is not exhaustive. Venue information — including opening hours, accessibility features, and availability of facilities — can change without notice and may occasionally be inaccurate or out of date. We do our best to keep listings current, but you should always use your own judgment, and check directly with a venue, before relying on a listing in a time-sensitive situation.

4. Membership Tiers, Pricing, and Payment

4.1 Free tier

New users may use a limited number of free searches after providing an email address, without a paid subscription. We may change the number of free searches available at any time.

4.2 Paid subscriptions

ComfortStop offers two paid membership tiers, billed in advance on a recurring basis:

Prices are set in US dollars. If you subscribe through the Apple App Store or Google Play, the price shown to you will be automatically converted to your local currency by Apple or Google; if you subscribe through our website, Stripe will charge your card in US dollars.

4.3 Auto-renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annual, matching your chosen plan) at the then-current price, until you cancel. You will be charged through the payment method on file with Stripe, Apple, or Google, depending on where you subscribed.

4.4 Cancellation and refunds

You can cancel your subscription at any time. If you subscribed via the website, you can cancel from your account settings (which uses Stripe's billing portal); if you subscribed via the App Store or Google Play, you must cancel through your Apple ID or Google account settings, per their respective rules.

Cancelling stops future renewals only — you'll keep full access for the remainder of the period you've already paid for. We do not provide partial refunds for unused time within a billing period, except where required by law.

4.5 Changing plans

You can upgrade or downgrade between ComfortStop and ComfortStop Plus from your account settings. Downgrades take effect at the end of your current billing period, with no proration.

4.6 Discount codes

Discount codes, where offered, apply to annual subscriptions only and are subject to any additional terms stated at the time they are offered.

5. Café Partners

ComfortStop offers separate partner tiers (Silver, Gold, and Platinum) for cafés and venues who wish to be listed or featured on ComfortStop. Café partner participation is governed by a separate partner agreement, made available to partners directly, and is not covered by these Terms.

6. Content You Submit

6.1 Your content and licence to us

When you submit a review, star rating, quick tag, comment, or photo ("Your Content"), you retain ownership of it. By submitting Your Content, you grant Landform Solutions Pty Ltd a worldwide, royalty-free, non-exclusive, sub-licensable licence to host, store, display, reproduce, and distribute Your Content as part of the Service — for example, showing your review to other travelers searching the same venue.

This licence continues even if you later delete Your Content or your account, because other travelers may already be relying on it and because removing individual pieces of shared community content after the fact isn't practically possible. If you delete your account, Your Content remains part of the Service but is anonymized — it is disconnected from your name and account, as described in our Privacy Policy.

6.2 Content standards

Your Content must be honest, based on a genuine visit or experience, and must not be defamatory, harassing, hateful, sexually explicit, unlawful, or infringe anyone else's rights. Don't submit content on behalf of a venue you own or are paid by, without disclosing that connection.

6.3 Moderation

We reserve the right to remove or restrict access to any content that violates these Terms, at our discretion, and to suspend or terminate accounts that repeatedly do so.

7. Accessibility Information

Accessibility ratings and tags on ComfortStop are based on community input and, where noted, venue-confirmed information. They are provided as a helpful guide, not a guarantee, and should not replace your own judgment about whether a venue genuinely meets your personal mobility or accessibility needs. If accessibility is critical for your visit, we recommend contacting the venue directly beforehand.

9. Intellectual Property

The ComfortStop app, website, branding, and the compiled database of venues, facilities, and quality scores are the exclusive property of Landform Solutions Pty Ltd, protected by copyright, trademark, and other intellectual property laws. Except for Your Content (see Section 6) and content we're required to attribute to third parties (such as OpenStreetMap or Mapillary), nothing in the Service may be copied, reproduced, or redistributed without our written permission.

10. Third-Party Services

The Service relies on third-party providers, including Supabase (hosting), Stripe, Apple, and Google (payments), and Google Places, OpenStreetMap, and Mapillary (venue data and imagery). We don't control these providers and aren't responsible for their availability, accuracy, or any outage or error originating with them. If a third-party outage affects the Service, we'll work to restore access as soon as reasonably possible.

11. Termination

You may stop using the Service and delete your account at any time (see our Privacy Policy for how). We may suspend or terminate your account if you materially breach these Terms, including by violating our content standards or acceptable use rules, or if we reasonably believe your account poses a risk to the Service or other users. Where practical, we'll give you notice and a chance to fix the issue first.

12. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we don't promise that the Service will be uninterrupted, error-free, or that any particular venue, facility, or piece of information will be accurate or available when you need it. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified — including those available to you under the Australian Consumer Law, the GDPR/UK GDPR, or equivalent consumer protection laws in your country of residence.

13. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 12 above, Landform Solutions Pty Ltd's total liability to you arising out of or related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential loss, including lost travel time, missed connections, or inconvenience arising from inaccurate or unavailable venue information — except where such liability cannot lawfully be limited or excluded.

14. Governing Law

These Terms are governed by the laws of Western Australia, Australia, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the non-exclusive jurisdiction of the courts of Western Australia, without limiting any right you may separately have to bring proceedings in your own country under local consumer protection law.

15. Changes to These Terms

We may update these Terms from time to time, for example as the Service grows or the law changes. We'll update the "Last updated" date above, and where a change is significant, we'll let you know in the app or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
